Terms of Use

This Vehicle Rental Agreement is entered into between FORTRAGO TRAVEL AND TOURS SDN BHD ("Fortrago") and The Renter ("Renter") (collectively the "Parties") and outlines the respective rights and obligations of the Parties relating to the rental of FORTRAGO vehicles. The terms and conditions may be modified from time to time — please check this page periodically for updates.

Acceptance of the Terms of Use

Please read the Terms of Use carefully before you start to use the Services. By accessing or using the Services, and/or accepting the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy which is incorporated into these Terms of Use by this reference. If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use the Services.

Identification of Rental Vehicle

Owner hereby agrees to rent to Renter a passenger vehicle identified as per mentioned in the Agreement signed by both parties.

Rental Term

The term of this Vehicle Rental Agreement runs from the date and hour of vehicle pickup as indicated in the rental agreement signed by both parties until the return of the vehicle to the Owner, and the completion of all terms of this agreement by both Parties.

Scope of Use

Renter will use the Rented Vehicle only for personal or routine business use and operate the Rented Vehicle only on properly maintained roads and parking lots. The Renter will comply with all applicable laws relating to holding licensure to operate the vehicle, and pertaining to the operation of motor vehicles. The Renter will not sublease the Rental Vehicle or use it as a vehicle for hire. The Renter will not take the vehicle beyond the location limit.

Rental Fees

The Renter will pay to the Owner rental fees for use of the Rental Vehicle as per agreed in the signed agreement. In the event that the car is returned later than the pick-up time, the renter will be charged late fees according to the Late Charge Schedule.

Booking Fees

The minimum RM100 Booking Fee must be paid to the company to proceed with the booking confirmation. The booking fee will not be refunded for any cancellation.

Security Deposit

The Renter will be required to provide a security deposit to the Owner ("Security Deposit") to be used in the event of loss or damage to the Rental Vehicle during the term of this agreement. In the event of damage to the Rental Vehicle, the Owner will apply this Security Deposit to defray the costs of necessary repairs or replacement. If the cost of repair or replacement of damage to the Rental Vehicle exceeds the amount of the Security Deposit, Renter will be responsible for payment to the Owner of the balance of this cost. In the event the Renter shall unilaterally terminate the rental before the expiry of the term hereby created, the Security Deposit shall be forfeited absolutely to the Owner without prejudice to the rights of the Owner to claims for any antecedent breach of this Agreement.

The renter is aware that:

  • The return deposit will be transferred during working hours only.
  • The return deposit will be transferred within 2–3 working days after the vehicle has been returned.

Extension of Rental Period

By using our services, you acknowledge and agree to the following terms regarding the extension of rental periods:

  • Extension Request: During the initial rental period, renters may request an extension verbally. However, this verbal request must be subsequently confirmed by the renter within 6 hours. By confirming, the renter acknowledges that any extension noted by a representative of the Licensee on the Licensee's records will accurately reflect such extension. This confirmation serves as an amendment to the original rental agreement.
  • Availability and Discretion: All extension requests are subject to availability and are at the sole discretion of the licensee.
  • No Subsequent Booking: Extensions are only possible when there is no subsequent booking for the rented item.
  • Payment for Extensions: To extend a rental beyond 12 hours, the renter must make payment before the extension is approved. No discounts will be offered for extended periods.
  • Prompt Payment: It is essential to complete the payment immediately to secure the extended duration. Failure to do so will result in the extension not being considered a daily rental rate. Instead, a late fee will be charged, potentially incurring additional costs.
  • Non-Payment Consequences: If the renter fails to make payment within 12 hours of the extension period being approved, FORTRAGO reserves the right to take possession of the rented item immediately, and the security deposit will be forfeited absolutely to the owner.

Collateral for Non-Payment

In the event that the renter fails to make payment for the rental vehicle as per the agreed terms and conditions, Fortrago reserves the right to retain and hold the renter's personal belongings provided as collateral until full payment is received, including any outstanding fees, charges, or damages.

Responsibility and Liability

Fortrago assumes no responsibility for loss, damage, or theft of the renter's personal belongings held as collateral. The renter acknowledges and agrees to release Fortrago from any claims, liabilities, or damages arising from the retention of their belongings as collateral.

Redemption and Release

Upon receipt of full payment, including any outstanding fees or charges, Fortrago will promptly release the renter's personal belongings. The renter must retrieve their belongings right away after the payment has been made. Failure to retrieve the belongings within the specified time may result in storage fees or the disposal of the belongings at the discretion of Fortrago.

Mileage

Mileage on the vehicle will be limited to the kilometres as per agreed in the signed agreement. Any mileage on the vehicle in excess of this limitation will be subject to an excess mileage surcharge depending on the type of the vehicle in the Surcharge Schedule.

Vehicle Regular Service

The Renter agrees to give a regular update on the mileage usage of the Rental Vehicle. In the event that the mileage approaches a certain mile based on the Service Schedule, the Renter will be responsible to send the car to the Service Center that will be booked by the Owner. All the service expenses will be borne by the Owner.

Insurance Claim

If the Rental Vehicle is damaged or destroyed while it is in the possession of the Renter, the Renter agrees to pay the monthly fees while the Rental Vehicle is being fixed. Only renters who take insurance will have their vehicle damages covered by the company. The renter who did not take the insurance will bear all the cost to fix the damages.

No Smoking and Durian Consumption Policy

Smoking and consumption of durian are strictly prohibited inside the rented vehicle. A penalty of RM400will be charged for each violation.

Indemnification

Renter agrees to indemnify, defend, and hold harmless the Owner for any loss, damage, or legal actions against the Owner as a result of the Renter's operation or use of the Rented Vehicle during the term of this Vehicle Rental Agreement. This includes any attorney fees necessarily incurred for these purposes. The Renter will also pay for any parking tickets, moving violations, or other citations received while in possession of the Rented Vehicle.

Representations and Warranties

The Owner represents and warrants that to the Owner's knowledge, the Rental Vehicle is in good condition and is safe for the ordinary operation of the vehicle.

Renter represents and warrants that Renter is legally entitled to operate a motor vehicle under the laws of this jurisdiction and will not operate it in violation of any laws, or in any negligent or illegal manner.

The Renter has been given an opportunity to examine the Rental Vehicle in advance of taking possession of it, and upon such inspection, is not aware of any damage existing on the vehicle other than that notated by a separate Existing Damage document.

Jurisdiction and Venue

In the event of any dispute over this agreement, this Vehicle Rental Agreement will be interpreted by the laws of Malaysia, and any lawsuit or arbitration must be brought in the corresponding region of Malaysia. If any portion of this agreement is found to be unenforceable by a court of competent jurisdiction, the remainder of the agreement would still have full force and effect.

Entire Agreement

This Vehicle Rental Agreement constitutes the entire agreement between the Parties with respect to this rental arrangement. No modification to this agreement can be made unless in writing signed by both Parties.

Privacy and Usage of Personal Information

By using our Services, you have given the consent to FORTRAGO to capture your Personal Information and you acknowledge to receive latest updates regarding our services. However, FORTRAGO has no right to share or sell your Personal Information to any third party without your consent.

The company applies data restriction access in which only certain employees can get the customer information. The company uses patch assessment tools and automated software testing to keep the network up to date and detect malware automatically.
